Right to Decline Service

Island & Luxury TRAVEL SPECIALISTS reserves the right to decline to provide services to any individual, and to decline or cancel a booking where we have reasonable grounds to believe it is fraudulent, at our discretion.

The Agency

Island & Luxury TRAVEL SPECIALISTS acts solely as an intermediary, arranging travel services on your behalf. We facilitate bookings with a range of independent transport, accommodation and wholesale/third party suppliers, who are responsible for delivering those services.

We do not own, operate or control these suppliers and cannot guarantee their performance, standards or suitability. All bookings are subject to the individual terms, conditions and limitations of liability imposed by the relevant Third Party Supplier. Any claims or recourse in relation to the provision of services must be directed to the supplier concerned, not Island & Luxury TRAVEL SPECIALISTS.

Should a Third Party Supplier be unable to deliver the services booked, any remedies or compensation remain the responsibility of that supplier.

We reserve the right to amend or cancel any itinerary or booking where necessary due to operational requirements or circumstances beyond our control.

Force Majeure

Compensation is not payable where changes arise due to circumstances beyond the control of Island & Luxury TRAVEL SPECIALISTS. Such circumstances may include, but are not limited to, war or threat of war, civil unrest or riots, terrorist activity, industrial action, natural or nuclear disasters, fire, epidemics or health risks, airline schedule changes or cancellations (including changes to airline or aircraft type), airport or port closures or congestion, severe or adverse weather conditions, and actions of governments or public authorities. These events are considered force majeure or Acts of God and are outside our reasonable control.

Insurance

Island & Luxury TRAVEL SPECIALISTS strongly recommends that all clients purchase a comprehensive travel insurance policy which will under certain circumstances and subject to policy conditions, cover such things as cancellation fees, baggage, personal liability, accident and medical cover. Travel insurance should be arranged at the same time as paying any deposit. We currently use CoverMore Travel Insurance and Go Insurance, please advise if you would like policy details and options to review. It is the responsibility of the traveller to assess and take out travel insurance as preferred and suitable for their travel requirements.  Should you require Island and Luxury TRAVEL SPECIALISTS to prepare or write a letter in support of an insurance claim, a fee will apply, starting from $100.00 (inclusive of GST) and varying depending on the complexity of the claim and time required. This fee is payable regardless of the outcome of your claim.

Responsibility

We act as an agent for various travel services. The traveller’s contract is with the travel service provider and not with us. All bookings are made subject to the terms and conditions and limitations of liability imposed by the travel service provider. While we do our best to ensure that travel arrangements are satisfactory, we are not responsible for the provision of travel services and have no control over travel service providers. We accept no liability whatsoever for any loss, cost, expense or inconvenience that any traveller may suffer as a result of an act or omission of any travel service provider or that is otherwise beyond our control. It is the responsibility of each traveller to arrange appropriate travel insurance. To the extent that liability cannot be excluded, liability is limited to the cost of the purchased travel services. Nothing in this clause affects your rights under the Australian Consumer Law.
